This Privacy Policy explains how we collect, use, disclose, and protect personal data when you:

- subscribe to our newsletter (if available)

Depending on how you use the website, we may collect:

2) ABOUT OUR PRODUCTS
Our products are digital sound design products such as synthesizer presets and preset banks.
Presets are configuration data (synth programs) intended for compatible synthesizers and software. Unless explicitly stated on the product page, presets do not contain sampled audio.

3) LICENSE AND PERMITTED USE
When you purchase a product, you receive a non-exclusive, non-transferable license for personal and commercial music production use.

You may:
1. use the presets in your own music productions
2. modify presets for your own use

You may not:
1. resell, share, upload, leak, or redistribute the presets (in whole or in part) in any form
2. include the presets in any competing product, library, or preset pack
3. transfer the license to another person or entity

All intellectual property rights remain with ULTIMATE X SOUNDS and/or the respective rights holders.

4) COMPATIBILITY AND CUSTOMER RESPONSIBILITY


Before purchasing, you are responsible for checking that:
1. the product is compatible with your synthesizer and/or software version
2. you know how to import or load the presets in your system
3. your setup meets any requirements listed on the product page

5) PRICES, PROMOTIONS, AND DISCOUNT CODES


1. Prices shown on the website are the current prices at the time you place the order.
2. Promotions and discount codes may be time-limited and may have exclusions (for example, bundles may be excluded). The applicable rules are shown on the website or in the promotion message.
3. Discount codes must be applied during checkout. After the order is completed, we cannot apply discounts retroactively.
4. Promotions generally cannot be combined unless explicitly stated.

6) ORDERING AND PAYMENT


1. Payments are handled by third party payment processors. We do not store your full payment card details.
2. Currently we accept payment via PayPal.
3. Your order is completed only after payment has been successfully processed.

7) DIGITAL DELIVERY (WIX)


1. Digital products are delivered electronically via our website platform (Wix) using an automated delivery system.
2. After a successful purchase, you will receive an order confirmation and delivery email to the email address used at checkout (often the email associated with your PayPal account).
3. Delivery typically includes a download link or access instructions. Access may also be available in your website account area (if you created an account at checkout).
4. If you do not receive the delivery email, please:
   a) check your spam/junk folder
   b) ensure your mailbox is not blocking automated messages
   c) contact us at: ultimatexsounds@gmail.com and include your order number

8) RIGHT OF WITHDRAWAL AND REFUNDS (DIGITAL CONTENT)


A) EU right of withdrawal
If you are a consumer in the European Union, you generally have a 14-day right of withdrawal.
For digital content not supplied on a tangible medium, this right may be lost once delivery begins if you have:
1. requested immediate delivery, and
2. acknowledged that you lose your right of withdrawal once delivery begins.

Where required, our checkout will request this confirmation before delivery starts.

B) Refund policy


Because our products are digital and delivered electronically, refunds are generally not offered after delivery has started, except where required by law.

Refunds may be considered in limited cases, for example:
1. duplicate purchase of the same product (refund or store credit after verification)
2. a proven technical defect in the delivered files that we cannot resolve within a reasonable time
3. a payment error clearly attributable to our system

Refunds are not granted for:
1. incompatibility with your system that was disclosed on the product page or could reasonably be verified before purchase
2. change of mind after delivery has started
3. failure to read product descriptions or requirements
4. issues caused by your local setup, software, or user error (we will still try to help you troubleshoot)

9) SUPPORT AND TECHNICAL HELP


We aim to help resolve technical issues related to accessing, downloading, and using the purchased content.
To troubleshoot, we may ask for:
1. your order number
2. system details (OS, DAW version, synth/software version)
3. screenshots or a clear description of the issue

10) RE-DOWNLOADS AND BACKUPS


1. You are responsible for keeping your own backups of purchased products.
2. As a courtesy, we may re-issue download links or provide re-delivery for previous orders after verifying proof of purchase.
3. Courtesy re-delivery is generally available for orders placed within the last 2 years. For older purchases, re-delivery may not be possible due to platform, storage, or licensing limitations, but you can still contact us and we will review your case.

11) DEMO CONTENT, TRADEMARKS, AND DISCLAIMERS


1. Any demo audio, video, or example content is provided for demonstration purposes only.
2. Third-party trademarks, product names, and brands are the property of their respective owners and are used only to describe compatibility or context.
3. If a product includes MIDI files or project files, this will be explicitly stated on the product page. Any such files are licensed under the same terms and may not be redistributed as standalone files or in competing products.

12) LIMITATION OF LIABILITY


To the maximum extent permitted by law:
1. we are not liable for indirect or consequential losses (for example, lost profits, lost data, or business interruption)
2. our total liability for any claim related to a purchase is limited to the amount you paid for the product in question

Nothing in these Terms limits liability where such limitation is not permitted by law.

We may update these Terms from time to time. The current version will be available on this page with the effective date.
